1. Who we are
Vizterior is operated by Szymon Niemiec, a sole trader registered in the Polish Central Register and Information on Economic Activity (CEIDG), with registered and correspondence address Kraśnica-Kolonia 77F, 62-590 Kraśnica-Kolonia, Poland, NIP 6653038169 and REGON 388609890 ("Vizterior", "we", "us" or "our").

2. Agreement and accounts
These Terms govern vizterior.com, your account and the related AI interior visualisation service (the "Service"). Our Privacy Notice explains how we process personal data. By creating an account or using the Service, you agree to these Terms. If you act for an organisation, you confirm that you are authorised to bind it.
You must be at least 18 and legally capable of entering into a contract. You must provide accurate information, keep your credentials confidential and promptly report suspected unauthorised use. Accounts are personal and non-transferable; sharing login credentials or creating accounts by automated or deceptive means is prohibited.
3. AI, Inputs and Outputs
The Service creates and edits interior-design concept images from photos, sketches, references, prompts and other material you submit ("Inputs"). You retain your rights in Inputs and grant us a worldwide, non-exclusive, royalty-free licence to host, copy, adapt, transmit and process them only as reasonably necessary to operate, secure and support the Service, comply with law and enforce these Terms. This licence ends when the content is deleted, except for lawful retention and temporary backups described in the Privacy Notice.
You confirm that you own each Input or have all permissions needed for its use and AI processing, including copyright, trade-mark, confidentiality, property, privacy, personal-data and likeness rights. You are responsible for Inputs and for how you use generated material ("Outputs").
As between you and Vizterior, we do not claim ownership of Outputs. Subject to law, third-party rights, these Terms and full payment, we grant you any rights we may have in an Output. Paid-plan Outputs may be used commercially; free-plan Outputs are for personal, non-commercial use only. Outputs may not be unique, protectable or free of third-party rights, and similar material may be generated for others. You must review and clear an Output before publishing, selling or using it for a client.
Outputs can contain invented details, distorted geometry, inaccurate dimensions, unsafe layouts and unsuitable or nonexistent products. They are concepts—not architectural drawings, construction documents, measurements, engineering, safety or professional advice. Verify all dimensions, materials, permissions, products, codes and safety requirements with a qualified professional before purchasing or building. Disclose AI generation or material manipulation where law requires it or omission could mislead. We do not use private Inputs or Outputs to train our own generative AI models or promote Vizterior without separate permission.
4. Acceptable use
You must not use, or help anyone use, the Service to:
- break the law, infringe rights, breach confidentiality or evade sanctions;
- create fraud, harmful impersonation or deepfakes, non-consensual intimate material, sexual material involving minors, or unlawful, hateful, defamatory or abusive content;
- present an Output as verified fact or a professional plan where harm may result;
- bypass security, safety, rate limits, credits, billing or access controls, probe for vulnerabilities, access another account or introduce malicious code;
- scrape, overload or automate the Service except through an interface we expressly provide, or reverse engineer it except where law expressly permits; or
- use the Service, its non-public materials or Outputs to build, train or improve a competing model or service without written permission.
We may investigate suspected misuse, preserve relevant evidence and proportionately restrict or remove content to protect users, third parties or the Service, or to comply with law. We may report apparently unlawful conduct where appropriate.
5. Plans, credits and payments
Current prices, currencies, billing periods, allowances and generation costs appear on the Pricing page and at checkout. The final checkout total controls over earlier promotional copy and includes applicable tax before you order. For Stripe Managed Payments purchases, the Stripe entity identified at checkout acts as merchant of record and handles payment processing, covered indirect tax, transaction support, refunds and disputes. We supply the Vizterior Service and do not store full card details.
Paid plans renew automatically for the selected monthly or annual period until cancelled, and you authorise recurring charges. Required renewal and price-change notices will be provided; changed subscription prices apply prospectively, no earlier than a permitted renewal.
Credits are a limited contractual right to request Service features—not money, stored value or property. They cannot be redeemed for cash, sold, transferred or used outside the Service. Generation cost is shown before submission. Subscription credits refresh monthly, do not accumulate and expire as stated for the plan. Purchased top-up credits do not expire while the account remains open, are available only with an eligible paid subscription and are used after subscription credits. The one-time free-render allowance is separate from paid credits and does not renew. Closing an account removes all unused allowances and credits.
A technical failure returns the allowance or credits reserved for that generation. A completed generation consumes the displayed amount even if it does not match your preferences, without limiting mandatory remedies for a non-conforming Service. If a purchase is refunded, the unused credits attributable to that purchase may be removed; independently purchased top-ups are not removed for a subscription refund.
6. Cancellation, withdrawal and refunds
You can cancel renewal through Settings → Billing or the Stripe/Link purchase management interface. Cancellation takes effect at the end of the paid period and access continues until then. Deleting your account also starts cancellation but is immediate and irreversible, removes product data and unused credits, and does not by itself create a refund. Download anything you wish to keep first.
EU/EEA consumers generally have 14 days to withdraw from a distance contract. If you separately request immediate supply, acknowledge the consequences and receive the legally required confirmation, the right may end for supplied digital content or after a service is fully performed. Starting a digital service at your express request may instead require payment proportionate to the service supplied before withdrawal. Accepting these Terms alone does not waive the right.
To withdraw, email an unambiguous statement to niemiec.say@gmail.com before the deadline, identifying yourself and the purchase. You may write: “I withdraw from my contract for [plan/purchase], ordered on [date], for account [email].”
Except where law, Stripe's Managed Payments rules or these Terms require otherwise, used credits and completed billing periods are non-refundable, convenience cancellations are not prorated and we provide no voluntary outage credits. This does not limit remedies for non-conformity, duplicate or unauthorised charges, or other mandatory rights.
7. Consumer rights
Consumers are entitled to digital content and services conforming to the contract. Depending on the circumstances, mandatory remedies may include bringing the Service into conformity, a proportionate price reduction, termination and reimbursement. Nothing in these Terms excludes or restricts those rights or the mandatory protection of the consumer's country of habitual residence. References to consumer rights include any individual sole trader who receives equivalent protection under mandatory law.
8. Availability and changes
We may maintain, update, replace or discontinue features for security, legal, technical or legitimate business reasons. We do not promise uninterrupted, error-free or permanently available service and provide no uptime SLA. Maintenance, internet failures, third-party providers and events outside our reasonable control may cause delay or downtime. We remain responsible where mandatory law requires it.
We may update these Terms prospectively. Material changes receive reasonable advance notice by email or in the Service. If you disagree, cancel before they take effect. Any additional notice, consent or termination right required for consumers remains unaffected.
9. Suspension and termination
We may proportionately restrict, suspend or terminate access for a material or repeated breach, fraud, misuse, a security or legal risk, unpaid amounts, or a binding provider or authority requirement. Where appropriate, we will give notice, reasons and a reasonable opportunity to remedy or appeal. We may act immediately where reasonably necessary to prevent harm, secure the Service or comply with law.
Termination does not erase accrued payment obligations or provisions intended to survive, including intellectual-property, liability and dispute terms. If we end a paid Service for convenience rather than your breach or an external legal reason, we will provide any refund required by law.
10. Disclaimers and liability
To the fullest extent permitted by law, the Service and Outputs are provided “as available”. We do not guarantee that an Output is unique, accurate, buildable, commercially successful, suitable for a purpose or free of third-party rights. Keep independent copies of important content and obtain appropriate professional and legal review. Nothing here overrides an express checkout commitment or a mandatory warranty or remedy.
Nothing excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer liability. For consumers, we are responsible for foreseeable loss caused by our breach or failure to use reasonable care and skill, but not business losses or loss caused by unlawful use, ignored instructions or events outside our control.
For business users, to the fullest lawful extent, neither party is liable for indirect or consequential loss or for lost profit, revenue, business, opportunity, goodwill or savings. Our total liability arising in any 12-month period is limited to the greater of the fees you paid us for the Service in that period and EUR 100. A business user will indemnify us against third-party claims, damages and reasonable costs caused by its unlawful Inputs or use of Outputs, or its material breach of sections 3 or 4. The cap and indemnity do not apply where prohibited by law or to intentional harm.
11. Law and general terms
Polish law governs these Terms. Consumers retain mandatory protection and may use any court available under applicable consumer law. Business users agree to the exclusive jurisdiction of the courts competent for our registered office. Contacting us first is encouraged but does not restrict urgent relief, limitation periods, consumer dispute resolution or access to a competent court.
We and our licensors own the Service, including its software, interface, branding, workflows, documentation and site content. We grant only a limited, non-exclusive, non-transferable, revocable right to use it as intended while these Terms are met. Feedback may be used worldwide, perpetually and without payment; do not submit confidential information as feedback.
These Terms and documents expressly incorporated into them form the agreement about the Service. If a provision is unenforceable, it is applied to the maximum lawful extent and the remainder continues. Delay in enforcement is not a waiver. You may not transfer the agreement without consent. We may transfer it in a reorganisation, financing or sale without reducing mandatory consumer rights. No partnership, employment, agency or joint venture is created.
